Terms of Use

These terms explain how our website and online ordering work for Órale Mexican Restaurant. By using our site, placing an order online, or using any related services, you agree to these terms.

1. Overview

Our website and online tools (the “Platform”) let you view menus, place pickup or delivery orders, and receive information from Órale Mexican Restaurant (“Órale,” “we,” “us,” or “our”). We are a local restaurant, not a tech company or delivery app.

2. Who Can Use the Site

You must be at least 18 years old to place an order or create an account through our Platform. By using the site, you confirm that you meet this requirement and that you will follow all applicable laws.

3. Accounts and Security

Some features may require you to create an account or provide contact information. You agree to:

  • Provide accurate, current information
  • Update your information if it changes
  • Keep your login details private and secure

You’re responsible for any activity that happens under your account. If you think your account has been compromised, please contact us right away at manager@theorale.com.

4. Online Orders and Payment

When you place an order through our Platform, you’ll see an itemized summary before you pay, including prices, taxes, and any delivery or service fees. By submitting your order, you authorize us and our payment processors to charge the payment method you provide.

Most payments are processed by third-party providers (such as Stripe or similar services). We do not store your full payment card details on our own systems. Their terms and privacy policies also apply.

5. Pricing, Taxes, and Fees

Menu items, prices, and availability may change without notice. Final amounts, including taxes and applicable fees, are shown at checkout before you confirm your order. Occasionally, prices on printed menus and online menus may differ; the online price at checkout is the one that applies to your online order.

6. Alcoholic Beverages

If alcoholic beverages are available for pickup or delivery and you include them in your order, you represent that you are at least 21 years of age. A valid government-issued ID may be required at pickup or delivery.

Alcohol may be withheld if the person receiving the order appears underage, has no valid ID, or appears visibly intoxicated. In those cases, alcohol will not be provided, and refunds may not be available.

7. Cancellations, Refunds, and Order Issues

8. Delivery and Pickup

Delivery and pickup options, estimated times, and any related fees are described in our Delivery Policy and Pickup Policy. When you place an order for delivery or pickup, you acknowledge and accept those terms, including delivery area limits and timing.

9. Loyalty and Rewards

From time to time, Órale may offer loyalty perks, punch cards, birthday rewards, or other guest offers. Details are described in our Loyalty / Rewards Policy on this page. These programs are promotional, have no cash value, and may change or end at any time.

10. Reviews and User Content

If you submit reviews, comments, photos, or other content (“User Content”) through our site or connected platforms, you grant Órale a non-exclusive, royalty-free license to use, display, and share that content for marketing and operational purposes.

You are responsible for what you post. You agree not to submit anything unlawful, abusive, hateful, misleading, or that violates anyone else’s rights. We may remove or refuse any content at our discretion.

11. Prohibited Uses

You agree not to:

  • Use the Platform for any illegal purpose
  • Try to access or tamper with systems you’re not authorized to use
  • Introduce viruses or other harmful code
  • Harvest or misuse other users’ information
  • Impersonate any person or misrepresent your identity

12. Third-Party Services

Our Platform may link to or work with third-party services (for example, maps, payment processors, or social media). We don’t control these services and aren’t responsible for their content, policies, or actions. Their terms and privacy policies apply when you use them.

13. Food, Allergies, and Your Responsibility

You are responsible for knowing your own allergies and dietary needs and for reviewing menu information carefully. Our kitchen handles common allergens, and while we do our best, we cannot guarantee that any item is completely free from cross-contact with allergens.

14. Disclaimers

Our website and online ordering tools are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not make any guarantees about the Platform being error-free, uninterrupted, or free of technical issues.

No information or advice (whether oral or written) obtained through the Platform creates any warranty not expressly stated in these terms.

15. Limitation of Liability

To the fullest extent permitted by law, Órale and its owners, employees, and representatives will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any online ordering, even if we have been advised of the possibility of such damages.

To the extent we are found liable for any claim related to your use of the Platform, our total liability will not exceed the amount you paid for the order giving rise to the claim.

16. Dispute Resolution and Governing Law

If a dispute comes up, we ask that you contact us first so we can try to resolve it informally.

These terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any lawsuit or court proceeding related to the Platform or these terms will be brought in the state or federal courts located in Michigan, and you consent to their jurisdiction.

17. Changes to These Terms

We may update these terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page. Continued use of the Platform after changes means you accept the updated terms.

18. Privacy
